Maybe, the seller has been very nice and did offer a refund if I couldn't get it fixed. I like it though so hopefully a tune will fix it.

A tune will fix it but it won't be cheap. It will require a custom tune.
Trifecta offers a K&N intake and tune for $400. If you can get your money back, it will be money ahead to go down that road.
